These are the terms and conditions by which we supply our Discovery Den classes and general services to you as a consumer.  We aim to provide the highest quality classes for all our customers and deliver the highest standard of service and are committed to the safety of all persons who attend our lessons.  

Participation 

Participating in a Discovery Den class is entirely at your own risk and you are responsible for supervising any child in your care at all times.  

By booking and attending a class, you agree that both you and any child under your care or supervision are able to take part in our classes and that it would not be harmful to either your or your child’s health, safety, comfort or physical condition to do so. Please note, we will not be liable for any loss, injury or damage suffered where you do not tell us about a medical condition, or you or the child do an activity which you are aware (or should have been aware) would, or might be, detrimental to you or the child.

As long as we have provided the Services with reasonable skill and care, we will not be liable to you for any loss, damage or injury suffered by you or a child for whom you are responsible as a consequence of you not following our instructions during the provision of our Classes or Services. 

 

Place Confirmation and Payment

Payment is due in full upon placing your booking with The Discovery Den and your place will only be confirmed on full payment.  An email acknowledgment will be sent confirming your place.  Payments taken for a term are non-refundable except in accordance with these terms and conditions. 

If we do not receive payments when due or any payment authorisation is cancelled by you (except in accordance with these terms and conditions) we may immediately terminate or suspend your enrolment with The Discovery Den including attendance at classes and you must pay us the sums that you owe outstanding. 

 

Siblings / Twins

All children must be under parental / carer supervision at all times.  Our classes are age specific and include age appropriate activities according to the class booked.   A younger sibling may attend our classes with an older sibling but the activities and play equipment may be beyond their stage of development so close parental / carer supervision is required.   An extra sibling is charged at £4 per child when accompanied by 1 adult.  

Child Minders

There is no discount for children attending from different family groups.  

Changes, Cancellation and Refunds

Cancelled PAYG bookings cannot be refunded unless there is a waitlist for the class and we are able to resell your place..

You may cancel your term block place provided you give at least 7 days notice in writing, prior to the start of the term.  Please note there may be an administration charge of up to one class for any changes made. 

If you wish to make a change to the time, date or venue of your class or your enrolment with The Discovery Den, please contact us as soon as possible. You will be informed if the change is possible. 

If the requested change cannot be made, you can make a request to cancel your term place.  Where we are not at fault and you are not within the cancellation period, a deduction may be made from any refund due to you, to compensate for the loss incurred as a result.

Your cancelled place, may at our absolute discretion be sold to another customer.  Where we are successful in doing so, we shall refund you for the sessions which you have cancelled.  A refund in any other circumstances where you cancel shall be at our sole and absolute discretion. 

For any classes you are not able to attend, you may gift your place to a friend with a similar aged child but do inform The Discovery Den in advance so we know to expect them.  

Illness

If you or your baby have any symptoms of Covid-19 including a sore throat, fever, a cough or loss of taste/smell or more general cold-type symptoms which are more common with the Omicron variant, please do not come to class.

Parents are asked to keep their children at home if they have a serious infection and to inform the setting as to the nature of the infection so that other parents can be alerted.
Please keep your child at home if he/she:

  • Has a fever or has had one in the previous 24 hours

  • Has had an upset stomach or diarrhoea in the previous 48 hours

  • Has heavy nasal discharge

  • Has discharging eyes

Has symptoms of a possible communicable diseases such as:

  • Measles

  • Chicken pox

  • German measles

  • Whooping cough

  • Impetigo

  • Scarlett fever

  • Hand, foot and mouth disease

  • Norovirus

  • COVID-19

We cannot offer a refund for a lesson missed due to illness. You may offer your place to a friend, who also has a baby, to the session. You would need to inform your Class Leader in this instance.

 

Holidays 

Regrettably we cannot offer discounts or refunds to cover your booked holidays due to the need to ensure continuity of service.
You may offer your place to a friend and their child to a session you know you are unable to attend. You would need to inform your Class Leader in this instance.

Our Right to Make Changes

We may have to occasionally change The Discovery Den experience to reflect changes in relevant laws, health and safety requirements (including any social distancing requirements or guidelines) and regulatory requirements.  

If We Cancel a Class

The Discovery Den will endeavour to run classes as planned.   If all or any part of any Discovery Den experiences at a venue has to be suspended or delayed by an event outside of our control, for example: teacher illness or absence, exceptionally bad weather, unavailability of the venue, widespread illness or lockdown / COVID restriction measures being imposed, you will be contacted as soon as possible (by email) to let you know. In these circumstances we have the right to:

  • Re-schedule and offer a venue experience on an alternative date at no extra cost to you

  • Substitute the experience online via a streaming platform such as 'Zoom'

Where such substitution or alternative offering has been made then we will not be liable and no discount or refund will be available for any such substitution or re-scheduled event. 

If however there is a risk of substantial delay to The Discovery Den classes re-commencing of more than 28 days and no substitution can be offered, you have the choice to receive a refund for any classes you have paid for but which have not yet been performed or carry sessions forward into the following term when classes resume as normal.

 

Intellectual Property

Intellectual property rights belong to us. All intellectual property rights in our classes including any materials provided to you in our provision of the same belongs to us.  Unless otherwise permitted by these terms, you must not permit any other person to use or benefit from any materials or information provided to you in the course of us providing you with our Services. 

 

Data Protection

The Discovery Den will record, process and keep your personal information secure in accordance with the Data Protection Act 2018. Information will not be passed onto a third party.

By booking you also accept we may pass on your details to the NHS Test and Trace System where there is a legal obligation to do so.

 

Videos, Photographs and Confidentiality

We love you taking pictures or videos of your own children throughout our classes and encourage you to share these on social media and with family and friends.  Please always be sensitive to taking pictures of others without their permission.  If the Class Leader feels that the amount of video is excessive, not just short clips, then you may be asked to stop.

Protection of Property

Please note that your property left in prams or bags is your responsibility and The Discovery Den cannot take any responsibility for the safeguarding of these items.

Health & Safety and Hygiene Policies

The Discovery Den follows rigorous internal checks of the venue and its own equipment to ensure that they are clean and safe. Daily Risk Assessments are conducted.
The Discovery Den asks all parents and carers to remove their shoes while in class in order to reduce the chance of transmission of microorganisms. Shoes need to be worn to visit the bathroom within class times and care exercised to avoid slips.

Changes to Terms and Conditions

The Discovery Den may from time to time updates these T&Cs. We will inform you of changes through regular channels of communication and you have 14 days to opt out of accepting changes in writing. Failure to do so will entitle The Discovery Den to treat this agreement with you as being updated with the changes.
